Terms of Service – Hat Patch Supply

Effective Date: Immediately

By accessing this website and/or placing an order with Hat Patch Supply, you agree to be bound by the following Terms of Service. If you do not agree, do not use this site or place an order.

1. Custom Manufacturing Agreement

All products sold by Hat Patch Supply are custom made-to-order.

By placing an order, you acknowledge and agree:

  • All items are produced based on customer-provided files, inputs, and approvals
  • You are fully responsible for reviewing all artwork, spelling, layout, sizing, and design details before submission or approval
  • Once submitted or approved, the order is considered final and ready for production

Hat Patch Supply is not responsible for customer-approved errors

2. Customer Supplied Artwork & Intellectual Property

By uploading, submitting, or approving any artwork, logo, or design, you represent and warrant that:

  • You own the rights to the content OR have obtained all necessary permissions and licenses to use it
  • You have the legal authority to reproduce and manufacture the submitted design
  • The content does not infringe on any copyright, trademark, or intellectual property rights

You grant Hat Patch Supply a non-exclusive, royalty-free, worldwide license to use the submitted content for the purpose of producing your order.

You further grant Hat Patch Supply the right to use, reproduce, display, and feature any items produced using your submitted artwork for marketing and promotional purposes, including but not limited to social media, websites, advertisements, sample packs, and video content, without compensation or additional approval.

You may provide an NDA form at the time of ordering to opt out of having any items produced shown on social media or used for promotional purposes. 

⚠️ You agree to indemnify and hold harmless Hat Patch Supply from any claims, damages, or legal actions arising from the use of submitted artwork.

Hat Patch Supply assumes no liability for intellectual property violations submitted by customers.

3. Proofing & Approval Responsibility

If proofs, mockups, or digital previews are provided:

  • Customer approval constitutes final acceptance of the design
  • Production will proceed exactly as approved

Hat Patch Supply is not liable for:

  • Misspellings
  • Low resolution artwork
  • Incorrect sizing or placement
  • Design errors approved by the customer

4. Product Variations & Manufacturing Tolerances

Due to the nature of custom manufacturing:

  • Slight variations in color, texture, alignment, sizing, and finish are normal
  • Differences may occur between:
    • Digital proofs and final product
    • Previous and future orders

These variations are not considered defects and are not grounds for refunds, returns, or disputes

5. Production & Shipping Terms

  • All orders are produced in the order received
  • Production timelines are estimates only and not guaranteed
  • Shipping timeframes apply only after production is complete

By placing an order, you agree:

  • Delays in production or shipping do not qualify for cancellations, refunds, or chargebacks
  • Hat Patch Supply is not responsible for shipping carrier delays, lost packages, or delivery issues

6. No Cancellation Policy

Due to the custom nature of our products:

  • Orders cannot be canceled or modified once production has begun
  • Requests to cancel due to delays, timing, or change of mind will be denied

7. Returns, Replacements & Refunds

All sales are final unless otherwise stated.

If there is a verified issue:

  • Customers must report it within the 72-hour inspection window after delivery
  • Hat Patch Supply reserves the right to repair, replace, or remake the order before issuing any refund

Refunds are:

  • Not guaranteed
  • Issued at our sole discretion only if a resolution cannot be completed

8. Chargebacks & Payment Disputes

By placing an order, you agree:

  • To contact Hat Patch Supply first to resolve any issue
  • That failure to follow posted policies (including the 72-hour inspection window) voids eligibility for claims
  • That initiating a chargeback without attempting resolution may be considered fraudulent activity

We reserve the right to:

  • Submit all documentation (including this agreement, approvals, and communication) to dispute chargebacks
  • Pursue recovery of funds, fees, and damages associated with fraudulent disputes

9. Limitation of Liability

Hat Patch Supply shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, business, or reputation
  • Delays caused by production issues, supply chain disruptions, or shipping carriers

Maximum liability is strictly limited to the amount paid for the specific order

10. Refusal of Service

We reserve the right to:

  • Refuse or cancel any order at our discretion
  • Deny service for abusive behavior, policy violations, or suspected fraud
  • Restrict or permanently ban customers from future purchases

11. Policy Acceptance

By using this website and placing an order, you confirm that:

  • You have read, understood, and agreed to these Terms of Service
  • These terms are binding and enforceable

12. Updates to Terms

Hat Patch Supply reserves the right to update or modify these Terms at any time without prior notice. Continued use of the website constitutes acceptance of any changes.

Bottom Line

You provide the design. You approve the design. We manufacture it.
We stand behind our work—but you are responsible for what you submit and approve.
